It seems like a pretty large percentage of the cases that go to trial are child sexual assault cases. Am I correct in assuming that is probably because defendants are not quick to plead to that type of charge?
ReplyDeleteI think it's partly that, yes. Pleading guilty means, in effect, agreeing to register as a sex offender and many defendants balk at that, perhaps unsurprisingly. But the cases also depend a lot on testimony from children, so I think often that's a factor.
ReplyDeleteOften those charges are multiple count indictments as well- i.e. different allegations of child sexual abuse all under the same charge for each alleged instance of abuse. That's an all or nothing proposition for the defendant. You either get a not guilty or (as I've personally seen) a half dozen 99 year sentences stacked on top of each other.
ReplyDeleteWhatever happened with this Huerta case? I was called for jury duty Monday but not seated, so was just curious about the result.
ReplyDeleteHe plead guilty, then the jury determined a sentencing of 60 years.

ReplyDeleteI was in the jury selection of Julio Hernandez-Martinez but was not selected I was curious as to what happened in the trial. What was the result?
